Yearbook Magic is committed to safeguarding your privacy online. The following policy discloses Yearbook Magic information collecting, use, and disclosure practices for our Yearbook Magic Sites. We reserve the right to revise this Yearbook Magic Privacy Statement (“TPS”) at any time at our discretion. Changes to the TPS will be effective upon posting to our Yearbook Magic Sites, so please review the TPS periodically.
1. CHILDREN'S ONLINE PRIVACY PROTECTION ACT
YearbookMagic.com takes special care to protect the safety and privacy of young people using our services, and encourages you to participate in your child's experience in cyberspace. YearbookMagic.com is a general audience site, and we do not knowingly collect information about children. For parents who are YearbookMagic.com members, YearbookMagic.com recommends that parents review the YearbookMagic.com Children’s Online Privacy Protection Act. You can also obtain additional information about safe surfing through the Federal Trade Commission website.
Collection and Use of Children's Personal Information
When your group collects age information and participants identify themselves as under 13, your group’s administrators will remove this information if consent from their parents for the collection, use and sharing of their children's personal information on YearbookMagic.com as described in this Privacy Statement is declined. If we change this YearbookMagic.com Privacy Statement in a way that expands the collection, use or disclosure of children's personal information the parent(s) will be notified and the parents(s) will be required to contact their group’s administrator(s) to request the removal of their child’s information if they are not comfortable with the new Yearbook Magic Privacy Statement. Parents can change or revoke the consent choices previously made, and review, edit or request the deletion of their children's personal information, by contacting their group’s administrator(s) at any time.
When using features that involve the collection of personal information such as participant profiles, coach/staff profiles and group announcements, these features will comply with the Children's Online Privacy Protection Act of 1998 ("COPPA"), and there will be a parental consent process in place. This Privacy Statement will be updated when these features are added, so please periodically review our Privacy Statement.
Your team’s administrator(s) using Yearbook Magic may ask for information about your child which can aid in the completion of your group’s yearbook. This information may include, but is not limited to legal name, date of birth, age, address, phone number, email address, personal interests, hobbies, likes, dislikes, and other personal information. YearbookMagic.com does not require this information and parents are notified via this privacy statement when such information is requested.
YearbookMagic.com will never share this information with third party advertisers. We maintain a high level of privacy and integrity to comply with the COPPA and to provide complete customer trust when using our products and services.

2. COLLECTION OF INFORMATION
As you navigate the Yearbook Magic Sites, Yearbook Magic may be collecting or tracking personal information in connection with the rendering of our services and the administration of the Yearbook Magic Sites, either by asking you to tell us something about yourself (for example, when you input your name, address, and email address during the registration process), or by using data-tracking software that tells us what advertisements or parts of the Yearbook Magic Sites have been of interest to you. Information about your activities may also be collected on an aggregate (i.e., group) basis, where we will not know or keep track of precisely who you are. Yearbook Magic may use this information, personal and aggregate, to tell you and other users about products or services that may be of interest to you. If you do not want to receive this information, please contact us at the address set forth in the Website Usage Corporate Policy. Personal information may also be used to contact you again, either by electronic communication (such as email) or by regular mail or telephone. The more information you volunteer, the better we can create a personalized experience at Yearbook Magic and tailor our services to your needs.
Please be aware that advertisements displayed on the Yearbook Magic Sites or third
party websites which are linked with the Yearbook Magic Sites may also collect
information about you. The information collection practices of those advertisers
and websites often are outside of our control and are not covered by this TPS.
3. COOKIES
As part of our ongoing effort to personalize our Yearbook Magic Sites and our services, Yearbook Magic uses cookies to store and retrieve information about you and your usage of the Yearbook Magic Sites. A cookie is a small amount of data that is sent to your browser from our Yearbook Magic Sites and stored on your computer’s hard drive. This data is used, among other things, to help us improve the Yearbook Magic Sites and to remind us who you are when you return to the Yearbook Magic Sites, allowing us to store your preferences and customize your web space. Cookies are also used to help ensure the overall accuracy of the data collection and analysis processes described above.
4. PRIVATE INFORMATION AND AMENDMENT CAPABILITY
Yearbook Magic will not use your private information for third party solicitations at any time. Yearbook Magic will periodically communicate with you using email to keep you updated on Yearbook Magic services and offering. If at any time you want to update, correct or amend any information you previously have given us, go to the “Team Info Section” page and follow the instructions. These procedure applies only to data collected by Yearbook Magic.
5. SUBSCRIBER SERVICES AND REGISTRATION DATA
In order to access certain Services (as defined in the T&C) within the
Yearbook Magic Sites, you may be asked to provide Registration Data through an
online registration form. You will then be supplied with a "login" and
"password." “Registration Data” may include your legal name, address, telephone
number, email address, subscriber name or "screen name," areas of interest,
and/or password used to access the Services. Yearbook Magic reserves the right to
request any additional information necessary to establish and maintain your
account in order to provide the Services.
Registration Data is the property of Yearbook Magic. Yearbook Magic maintains a
secured area on the Yearbook Magic Sites for transmission of Registration Data,
and stores all Registration Data in a database that is subject to industry
standard security protection. Yearbook Magic reserves the right to use your
Registration Data to send you information about Yearbook Magic, the Yearbook
Magic
Sites, Yearbook Magic products and services, and other topics in which you have
indicated an interest.
Use of the Yearbook Magic Sites is conditioned on your provision of requested
information in an accurate and truthful fashion. If you choose not to provide
such information, you may not be able to access some or all of the Yearbook
Magic
Sites. You may cancel your account at any time by sending an email to
Yearbook Magic. Once Yearbook Magic has finished
processing the cancellation, Yearbook Magic will delete all your Registration Data
from its database. Although Yearbook Magic will use all reasonable efforts to
safeguard the confidentiality of the Registration Data, transmissions made by
means of the Internet cannot be guaranteed to be secure. Yearbook Magic has no
liability for disclosure of Registration Data due to errors in transmission or
unauthorized acts of third parties.
6. REGULATORY ISSUES
Due to the existing regulatory environment, Yearbook Magic cannot ensure that all of your private communications and other personal information, including Registration Data, will never be disclosed in ways not otherwise described in this TMPS. Yearbook Magic may be forced to disclose information to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications. Further, Yearbook Magic can (and you authorize us to) disclose any information about you to law enforcement or other government officials as Yearbook Magic, in its sole discretion, believes necessary or appropriate. Therefore, although Yearbook Magic strives to maintain industry standard practices to protect your privacy, Yearbook Magic does not promise that your personally identifiable information or private communications can remain private.
7. YOUR CONSENT
You hereby consent to the collection and use of your information as described herein. You are responsible for the periodic review of this TPS to ensure your knowledge of any fundamental change to the uses of the information described herein.
